A deed of separation, sometimes called a Separation Deed, is a formal document which is drawn up when a couple have decided to separate but do not wish to commence divorce proceedings.
The document confirms essential details, such as any agreed financial arrangements, the date of separation, and any other relevant information. Both sides to the agreement, the parties, sign and keep a copy of the deed of separation and this can be used later if any court proceedings take place. Whilst a deed of separation is not legally binding, it is often taken seriously by the courts, and is used to help a court to make a decision on any court orders.
A prenuptial agreement, or pre-nup, is a written agreement between two partners about the ownership of all of their belongings and possessions should their marriage breakdown, usually agreed upon before the marriage.
Whilst a prenuptial agreement is also not legally binding, it is used to inform a court’s decision in relation to any legal proceedings that take place in the future.
A pre-nup essentially decides who gets what in the event of a marriage ending, and this includes all property and finances, covering everything from homes and cars, to finances and financial assets.
